POM Wonderful Wellness Statements Cause Prosecution From FTC

Companies will often get in trouble for the statements they make about products in advertising. The U.S. Federal Trade Commission has decided to take a step up and sue, according to the Wall Street Journal, the POM Wonderful LLC that makes a pomegranate juice drink in Los Angeles. The Federal Trade Commission suit is all about what is in the POM Wonderful products. Federal Trade Commission goes in opposition to POM Wonderful down and dirty
Products from POM Wonderful are shown to “proven to fight for cardiovascular, prostate and erectile health,” in studies explains the WSJ. The FTC explains that having “17 percent improved blood flow” and a “30 percent decrease in arterial plaque” aren’t enough evidence to advertise that way. The statements are backed by “unprecedented scientific research,” which is what POM Wonderful claims although it is not quite legitimate. “Any consumer who sees POM Wonderful products as a silver bullet against disease has been misled,” David Vladeck of the FTC’s Bureau of Consumer Protection said in a media statement.
POM Wonderful had filed a pre-emptive suit from the FTC
POM Wonderful made complaints about the FTC. Apparently the business thinks it is unreasonable for making such requirements. Two weeks before the FTC even generated its lawsuit, POM Wonderful had gone on record that the FTC’s requirements were squelching POM Wonderful’s First Amendment free-speech rights. While the FTC hasn’t played the previous Supreme Court Justice Oliver Wendell Holmes card of falsely shouting “fire” in a crowded theater as an illustration of the limits of free speech, POM Wonderful’s health statements – if indeed the statements are unverified – do raise reasonable questions, thinking about their specificity. POM Wonderful put out some ads that were especially interesting. The ads stated the only way to protect from prostate-specific antigens, or PSAs, was via drinking its pomegranate juice. The WSJ claims this has not been proven scientifically at all. Customers may end up getting products depending on claims that aren’t real.
